GENERAL TERMS
Breeder guarantees that the dog, to the best of her knowledge, to be healthy upon arrival to the Buyer. The dog has been seen by a licensed veterinarian and has had age appropriate vaccines and overall health check before leaving the Breeders home. The dog is also microchipped and dewormed.
The dog is being sold on non-breeding terms. Buyer must send to the Breeder written proof, from a licensed veterinarian, that the dog has been spayed or neutered before he/she is 12 months old (and not before 6 months of age or health guarantee will be void). Buyer understands that the dog is being sold for the sole purpose of being a family companion or working dog (obedience, agility, tracking, etc). The dog is not to be used for breeding purposes, accidental or otherwise, or conformation competition. If the Dog is bred, on purpose or accidental, the buyer will be fined $5000 and the breeder has the right to repossess the Dog and all puppies produced by the Dog. If produced puppies were already sent to new homes before Breeder was aware of this breaching of contract, Buyer will be fined $1500 per puppy sold. Breeder will decide if the Dog will be returned after the dog is spayed/neutered (spay/neuter at buyer's expense before return). Legal action will be taken if necessary and Buyer will be responsible for all the Breeders legal costs.
Buyer agrees to never sell or give the Dog to any pet store, dog dealer, broker, research laboratory or guard dog business. The Breeder is to be notified if the buyer can no longer keep said dog. Buyer will return the dog to Breeder with no reimbursement. If Buyer has a friend or family member wanting the Dog, the Breeder will have final decision, and it will be discussed with all parties. Breeder also agrees to take the Dog back at any time in the life of the Dog if the Buyer can no longer keep the dog. Strict return policy. If the dog is sold or given away without breeder’s permission, Buyer will be fined $5000 and the Dog is to be returned to the Breeder as new owner; this includes the CKC registration to be signed back over to the Breeder. Breeder has all rights to repossess the dog.
The Buyer agrees, if at any time the Dog were to be found abused or neglected, that the Breeder has the right and obligation to repossess the dog. No compensation made to Buyer. This includes breaching any part of the contract, poor body condition due to lack of care, denying vet care for any reason, etc.
If repossession needs to occur, the Buyer agrees to allow the Breeder and/or chosen affiliates access to the Buyers place of residents to obtain the Dog.

Buyer agrees that he/she is physically and financially able to accept ownership of the Dog. Upon acknowledgment and acceptance of the terms the new owner will provide for the following:
1. To provide the Dog with a safe and (indoor) loving home. The Dog will be properly kenneled and at no time will be chained outside unattended or allowed to roam freely. The Dog will be fed a premium quality diet and have access to water at all times. The Dog will be kept up to date on all vaccinations.
2. Buyer will be responsible for all costs incurred during ownership of the Dog. This is to include all expenses for annual vaccinations and veterinary services, food, fees involving training classes and travel expenditures.
3. Buyer agrees to contact the Breeder immediately in the event the Dog becomes seriously ill, has been lost/stolen, or has died.
4. Buyer agrees to notify Breeder with any changes of address or contact information.
Should the Buyer find themselves unable or unwilling to fully comply with the terms of this contract, with respect to care, etc., the Dog must be returned to the Breeder, Barrett Kennels. Failure to return the Dog under these circumstances, the Buyer hereby gives the Breeder the following options:
1. The Breeder and/or chosen affiliates may take possession of the Dog from the Buyer's property and the Buyer signs over any paperwork (CKC) to the Breeder, making this contract null and void; or
2. The Breeder can subject the Buyer to liquidated damages in the amount of $5,000.00, attorney’s fees in the amount of $2000.00, and the legal cost of bringing this action to enforce the terms of the contract.
HEALTH GUARENTEE
The Buyer has 72 hours to have the Dog examined by a licensed Veterinarian. If, as a result of the examination, the Vet determines that the Dog is not in good health, the Buyer shall choose to keep the Dog, return the Dog to the Breeder for a refund (minus $500non refundable deposit) or get a replacement Dog at Breeders discretion. The Buyer must notify the Breeder within the 72 hours. If Buyer chooses to return the Dog, the dog must be returned within 7 days of signing the contract, along with a written certificate from the Vet stating the Dog was ill when examined. This 72 hour guarantee does NOT cover parvo.
The Breeder guarantees that the dog is to be free of any genetic disease until the age of 24 months. If this dog is diagnosed with a genetic disease that will preclude it’s living an otherwise normal and healthy life, Breeder will replace the dog with one of equal value from the first available litter upon receipt of a copy of the diagnosis by a licensed veterinarian. (Any of the disorders must be of a completely genetic origin and not the result of environmental factors, poor nutrition, accidents or illness incurred after Buyer has taken possession of the Dog). No Cash Or Medical Expenses Reimbursed. Breeder reserves the rights to have a second veterinarian of their choice evaluate the Dog’s condition before honoring guarantee The Buyer will be responsible for all transportation costs.
In the case of the Dog passing on or before the age 24 months, a written statement from your Veterinarian as well as a Necropsy must be performed and sent to the Breeder at Barrett Danes, stating that the Dog indeed passed away and the cause of death. This is to ensure continued good genetic health of our lines. No replacement pup or refund will be honored without a NECROPSY.
Health Guarantee will be null and void if any terms are not met.
I have read and understood the terms and conditions for this contract and agree to abide by them.
